A lot of people still imagine that judges are a sacred class who are magically above the political and cultural fray. In reality, they are mostly petty little tyrants who think themselves the kings and queens of their little courtroom fiefdoms. Thousands of them should have impeached by now, but virtually none of them have been. They represent the greatest persistent threat to the west.
Top it off they're a largely self selected and nearly unaccountable class.
Which is why reform of the country will not be peaceable. Because you can't have a solution without punishing the guilty.
Post-1965-stock judges and especially millennials are the enemy. Founding stock boomer judges are why we don't have state sponsored Red Guard patrols in blue areas yet.

I'm actually for this. I hope all the lower courts openly defy SCOTUS. They're going to put them in the position of either issuing a soul-crushing ruling that pretty much takes gun control completely out of the hands of the states, or they're going to show themselves to be completely impotent.
If it's the latter, you can expect right leaning states to jump on the bandwagon and begin ignoring any SCOTUS rulings that aren't consistent with their worldview as well.
Then we have the complete collapse of one of the branches of government, and some real shit might kick off.

The Constitution and Bill of Rights haven't been worth the paper they are printed on for quite some time. The right needs to come to terms with this. There are no more mutual rules, no more law. Party hard or don't party at all.

While I'm assuming the frizzy haired negress is probably a shitty judge it has a very low understanding of the law, surely she knows that after saying that her decision will be automatically appealed, and the next higher court will be practically compelled to hear the case. At that point, you might as well save the paper you were using to write the rest of your opinion, as they'll be pretty much starting from scratch anyway.

The guy bought gun parts and was building guns and failed to register them. You need to register your firearms in New York within 30 days, where he lived. He made thirteen guns and didn't bother registering them. That seems to be what all those charges pertain to.
So I guess what the judge was saying, as dumb as it sounds, is referring to how the 10th Amendment allows stipulations on other Amendments so the defense's argument of "but the 2nd Amendment lets us own guns" doesn't hold water since he failed the other half and failed to register his weapons since that's what the law is in New York.
This is just based off of the article, I haven't read the court transcript to see if it has further context.

This is New York City, gun licenses don't exist there. And if it isn't the state ensuring that, it's the city. You have to bribe one of two people at any given time (usually both) to get pistol permits or be the child of a police officer.
I am also looking for the transcript though, if you find it send it to me because I have a hard time seeing anyone actually saying that.

I mean, people let these retarded laws be passed for decades now. A lot of infringement was allowed, which is how we get to the part like this where the court can in fact say dumb shit and have the legal framework to be correct on it.
That's why you never concede an inch. Because it takes 10x the force to get rid of garbage than it does to prevent it from coming to pass to begin with.
It's even worse than that: Infringement is thanks to the 10th Amendment but if you knock down one of the Amendments of the Bill of Rights, it makes the rest more susceptible for the same. And there could be further problems if you get rid of the Amendment that reserves power to the states - we could end up with a much more powerful federal government.
So even if you painstakingly got rid of all the garbage, there is no way to prevent it from building back up again.
Their violation of the 2nd isn't because of the 10th. That's just rationale to run this person through the system. It's true there has been debate on that forever (and if states just decide not to follow the courts then we have fun times ahead) but from the perspective of federal courts, incorporation is settled law especially when it comes to the bill of rights.
We should make all laws expire automatically.
