Whatever little LLC she was working for is done. However the industry is structured to survive these lawsuits since they are so common. I'd say your avg OBGYN gets legit sued once a year. And goes to trial maybe 1 in 5. So they don't keep cash in these vehicles, and for the most part assets are leased or finance. The shell just exists to collect payments and pay employees. It's not a permanent thing or even the same as the brand. So you can clean one out and own it. Enjoy the debt.
Tbh if you disqualified every one whose mistake led to a death there wouldn't be any. In some places there aren't any. When the proceeds can't pay the malpractice insurance they disappear.
I recommend you just get one you trust and all their partners too. Everyone makes mistakes. Not everyone decapitates your kid tho.
How do they stay in business then? My understanding is that doctors fight malpractice suits as hard as they do because a black mark on their record makes malpractice insurance too expensive to keep the practice going.

I didn't know that. My experience of most of them is that they settle. I don't know the terms, but I know a lot of times settlements in general include no admission of wrongdoing.
I can certainly see people being uninsurable. But I don't know of any. Basically, any award in a case related to infants would bankrupt any practice. It's always millions of dollars, and like I say they don't just have that laying around. People aren't gonna spend the rest of their life paying off a debt. What happens is the liable entities get liquidated and then GL.

Midwifes aren't integrated into the hospital system here in the slightest, so midwifery is almost exclusively the domain of "home births" only. Which creates stigmas in both directions that keep each one alive and the way it is.
Also, hospital births are often incredibly expensive even for the most perfect birth possible, and its a debt almost everyone in the nation will incur at least once at some point. So the hospitals have vested interest in keeping things in house and exactly like they are to continue to screw over middle America, as nearly everyone else either just ignores the debt or gets it completely covered by tax funded programs.

I was just pointing out that midwives aren't a viable alternative. I'm not even confident that midwives use forceps/vacuum suction for complicated vaginal deliveries.
Midwives are fine for uncomplicated young, healthy deliveries. They do have some legit training. They, for example, are a lot more legit than say, chiropractors.
But they operate from a typical feminist model: skim off the easy cases, carry yourself like you are better than the actual specialist doctors, buy into all the latest feel good useless bunk, immediately drop your principles the very second you meet any adversity, run for help to the doctors you just had so much disdain for and their methods, go home leaving the actual professionals to clean up your literal mess.
Over here a midwifery degree is a four year degree, same as a nurse. It is one year less than a doctor, and the difference is about a year spent on the wards with training wheels and mentor. Doctors do more placements on the ward.
New nurses and midwives then spend a year under supervision before they are fully qualified. Midwives work in hospital birthing suites as well as hospital-run home birth services.
Home births are not always a stupid idea. It depends on the risk-factors and the level of support required. It takes a surgeon an hour to scrub-up for a A1 C-Section, so as long as no one is bleeding to death (which drugs can fix, mostly) then a trip in the ambulance doesn't slow down a surgical intervention.

Now she files a lawsuit, which if successful will almost certainly be paid out by insurance, which raises rates for not only diversity hospital but all hospitals, and helps continue the death spiral of rising health care costs.
So no matter what happens, everybody gets to pay for this incompetence. It would be one thing if the people doing this idiotic shit bore the costs for it, but it doesn't work that way. The Mom is also about 300 lbs. Now I'm not an expert on why but I hear every week about how bad it is for mothers to be obese. It's one of the main reasons for the US's supposedly poor maternal death rate. Hypertension kills pregnant women and sometimes babies. Basically being fat and pregnant is just doubling down on risk.

I'm just an observer, but it seems like most patients have hypertension. Many babies are oversized due to mother's diabetes. It is a major cause of infant and maternal death. May have actually had something to do with this case because difficulty in delivery can be due to the baby's size.
My lil sis delivered my nephew at just under 13 lbs, and was herself underweight.

However, truth is absolute, not relative. The further they push toward their end goal, the more people will notice and rebel. I'm about 99% sure they mean an internal decapitation, which newborns are particularly susceptible to. It happens every so often when a baby gets stuck in the canal. Basically, a newborn lacks strength in the muscles and ligaments that hold your head on, so it's easy to pull their head right off the spine. Almost always, this results in the brain stem being severely damaged, which is immediate death.
It still requires quite a bit of negligence and/or stupidity though. This "doctor" was delivering a baby without knowing how much force you can apply to a newborn's head before it becomes dangerous. I would question whether she even showed up for class before they started putting lives in her hands.
I have never heard of a baby's head being ripped clean off before, and I suspect it would require inhuman strength to do so.
The Fox clip mentioned that the 20-year-old mother was a diabetic. From the press conference vid, she also appears to be very short and a stockier build, yet not a land whale.
I suspected before even watching the clip that the mother was either diabetic or developed gestational diabetes.
Increased blood sugars and resulting increased blood insulin levels leads to macrosomia (literally "big bodied" babies) that grow too big in their cage to fit out the escape hatch.

Every bad outcome in obstetrics is an unfathomable tragedy, but childbirth is inherently dangerous, especially with 2023 physiognomy.
There's a reason why mother and infant mortality was historically so high.
We like to think that we've come so far in making the process a lot safer. But anyone who has experience on both the bystander and provider side knows that the modern version of natural childbirth still involves tons of elbow grease and brute force from the obstetrician hands, especially when shit goes south.
When I witnessed the birth of my son I was shocked at how violent it was. It looked like my wife was the victim of a horrible crime. Little dude came out safe and the whole procedure went about as smoothly as it could have but even then it was a messy, messy process.
First baby, wife had been in labor for about 20 hours. Baby's heart rate was dropping, and everyone was getting very tense. The baby crowned but didn't move much further, and we were minutes away from an emergency c-section. There was fluid (and more), everywhere, wife was screaming and sweating, it was fucking brutal.
Baby comes out, wife is so out of it from the pain and exhaustion she had this 1000-yard stare for a couple of minutes before she snapped out of it (had refused all medicines). She was also bleeding quite badly from a tear when the baby came out.
In retrospect, it was a fairly typical delivery, baby was healthy, mom was healthy, we left the hospital on the usual schedule, etc.
Giving birth is quite literally a link to the human condition that is shared by all humans since the beginning.
There is a reason why men have evolved to get those instinctual rushes of "my child" love the moment they lay eyes on the little things.
Because if we didn't get it right then most would fucking bolt just from sheer disgust.

It's easier than it looks. Babies are fragile, and you potentially have to pull very hard to get them out.
Every time something bad happens they go right to "failed to perform a C-section. But that's a calculated risk in and of itself. They're not refusing out of laziness. It's easier for them to do surgery than deal with a complicated delivery. But going into emergency surgery is not your first choice.
There are simply too many unknowns here, but ALL law suits have two sides. It sounds absolutely horrific, and it IS absolutely horrific. Let's not lose site of the fact that a child is dead, and a mother and father have lost their baby.
There are no doubt many factors. Quite obese mother and (statistically speaking given her weight) a highly likelihood of gestational diabetes, both of which are major risk factors for pregnancy problems. G.D. babies are sometimes just so fat they can't get out.
The Dr was not an employee of the hospital and has been practicing for 20+ years.
Maybe she was 100% negligent and 100% to blame, and maybe it was a one in a 100 million freak accident. I feel bad for all involved.

In case you didn't want to read, they actually placed the head on the body and wrapped it tightly and gave it to the Mother to try to conceal it.
Considering that absolute, near-impossibility of a decapitation during regular delivery and the stunningly unlikely chance of something like that accidentally occurring during a c-section, I'm gonna go out on a limb here and say "reserve judgement, we don't have the full story yet", gentlemen. For all we know, the child was non-viable and/or already dead when the delivery was first attempted, and a delivery-by-parts was the least bad option once they began the c-section and got a clear look inside the mother.
