I do think lootboxes and gacha will eventually count as gambling, at least in more countries like in Europe, but I would have started with EA using FIFA to promote gambling to kids. That's how you know they just want to stick it to Valve.

You can’t even sell Steam Marketplace goods (i.e. the skins and lootboxes) for real money (while following the rules). Market transactions give you SteamBux^tm and third party transactions are a violation of the Steam terms of use.

Diablo 3's Real Money Auction House definitively proved that there is no such thing as mtx monetization that does not negatively impact game design. Blizzard immediately destroyed loot balance and cranked difficulty in order to funnel people towards purchasing gear (with Bliz receiving a cut of all proceeds).

Remember Little Big Planet? That game allowed you to give anyone everything you had, and you got to keep it. It was anti monitezation. That game was bought just to put an end to that practice.
As soon as you imply that one pack can be better than another, it's gambling. It is possible for card packs to not be gambling - even items that aren't blind boxed get sold by waves just so you or the retailer can simplify your logistics - but you can tell that card packs are gambling if the company makes the rarest cards the most desirable cards rather than the most niche cards.

Without even looking at the article or knowing which game this is about, I would say that if the game pushes methods to earn the currency used to get the lootboxes by spending real world money, then yes, a case for gambling could be made. At the very least, it is definitely purposefully predatory.

there is a guaranteed payout (you bought “a pack of cards” and you got “a pack of cards”). The exact same scenario applies to loot boxes
alternative value/functional use (you can play Pokémon with your Pokémon cards as opposed to just reselling them). The exact same scenario applies to loot boxes/skins
no cash payouts. All “cash value” resides in the secondary market. Again, the EXACT SAME SCENARIO APPLIES TO LOOTBOXES.

Depends on the company, most allowed you to get what you wanted within a reasonable amount of chance and some were always rare valued. Around the late 80s early 90s trading cards starting losing momentum from over saturation which saw the super omega rare cards being printed to drive sales. This worsened with eBay and online platforms because basic supply and demand.
