Without even looking at the article or knowing which game this is about, I would say that if the game pushes methods to earn the currency used to get the lootboxes by spending real world money, then yes, a case for gambling could be made. At the very least, it is definitely purposefully predatory.

The “loot boxes” are free from playing. You spend real money on a key. The items you receive have no cash value beyond the secondary resale market.

This isn't about gambling at all. This is about hurting Valve by any means possible. There is a global ongoing attack on Valve because they allow players to have a voice. Valve allows refunds, Valve allows discussions, and Valve demands AI slop disclosure. That cannot be allowed to stand, because all of your money belongs to the megacorporations. You must be in debt at all times.
It’s about gambling in so far that valve does have a loot box market. I agree the only reason they’re only going after valve isn’t because of the gambling aspect. However, loot boxes have been targeted for a long time for child gambling.
The difference is there is no real currency involved, selling on the marketplace only returns store credit.
