Yes, you can ask for a speedy trial. But then you have practically no time to work on your defense.
Government has unlimited resources and literally everything ready for use in prosecution from the word go. Defense might have to do discovery, collect depositions, and file motions to try to unfuck you.
So, yes, they "opted" to sit in jail in the same way that handing over your wallet in the face of a gun pointed at your face is "opting" to give a friendly gift to your assailant.
