Gaige Grosskreutz sues Kyle Rittenhouse for shooting him, lawsuit says he "approached with his hands in the air to try to ease the situation and stop the killing. Obvious weaponized litigation.

He was already aquitted of the act he's being sued for, there's no way the case can go forward if the judge has a shred of integrity.

This is a feeble attempt at a) harassement, b) getting a payout from one of the many defendents named, and c) showing Kyle that he should have double tapped.

You can lose a civil case for something that you weren't convicted for, right? It's a lower standard of evidence.

Call me crazy, but I thought that OJ and MJ ended up acquitted of stuff that they later paid for civil suits on.

Correct. The only saving grace will be if the judge dismisses the suit with prejudice. Meaning it's over, done and cannot be appealed.

That is correct. The standard of proof in a civil case is, a preponderance of evidence vs. the standard of proof in a criminal case is beyond all reasonable doubt.

IIRC in the case of MJ it was the other way round. (At least one of them.) The judge refused to move the civil case after the criminal case so MJ was advised to settle the case rather than reveal their defense. They then skipped town rather than testify in their own criminal case.

IIRC, that was in an interview rather than in court, so its not on the record legally speaking. Now of course, his lawyer would have to pull off the mother of all arguments to make it so that that interview would be kept out of the court in this case, but it is a non-zero chance (just that non-zero is like 1%, if we are generous).

Everything I've seen about Gaige (what a stupid name) leads me to believe he is just the worst. I went to high school with a few guys like that. One of them even went to Occupy Wall Street where he proceeded to act like an idiot and accomplish nothing with his life ever since.

If anything, the armless fag needs to be reminded that if he HAD died, it still would've been considered justifiable homicide, and Kyle STILL would have been ruled "not guilty." This should have been a "second chance at life" moment for him, but he's so deluded with hatred that vengeance is his only remaining goal in life.

I still think that the moron was greatly beneficial for Kyle during his trial. He literally admitted on the stand, under oath, that Kyle hadn't shot him while his hands were in the air and he was approaching him, that Kyle only shot his arm once he had lowered it and was pointing his gun at Kyle's head.

This most likely gave a very positive image of Kyle for the jury. It showed that he had great restraint; that he wasn't just shooting people wantonly, that he was only defending himself, and that he has enough discipline to determine that the threat to his life ended the moment Gaige's arm was shot, and did not need to shoot him dead.

He literally admitted in a court of law that he advanced towards Kyle with his handgun pointed towards him. This case should be laughed out of the room.

People like Gaige will never learn their lesson. If I'm Kyle, I would countersue.

... you can still be held liable for perjury in a civil trial, yes?

Because I'm fairly sure the judgement for the criminal trial will include the facts of the matter, so unless Grosskreutz is going to try and re-litigate a criminal trial in a civil setting, Rittenhouse is going to be able to bring in the judgment of a duly-constituted court to show that Grosskreutz is perjuring himself for profit.

Just because you sue doesn’t mean you have a case. I suspect this will be dismissed quickly at least as to Rittenhouse. There could be some legal theory that works for finding the city or other entities liable for a bit of money but I doubt Kyle pays anything here.
