Because if you can take a product explicitly labeled "hot coffee", put it between your legs and of course you get burned but still sue... Then of course you can drink caffeine until you die and still sue the restaurant.
If liability can't be waived with clear textual or verbal warnings in English affirmed by customer, sure I'd agree. But "hot" isn't a reasonably unambiguous qualifier for scalding coffee served at a nationwide chain drive through.

From the name and not having been in Panera Bread in years I assumed there was some electrical malfunction somehow with the lemonade mixers. This is somehow even more retarded. People need to find that happy medium between avoiding any and all adversity including pushing their own body, and fucking killing themselves NOT listening to "let me fucking sleep" signals. Not quite the case here, but it needed to be said. It is still stupider than the electric issue idea because the bitch KNEW not to drink energy drinks. If the server had fucked up and gave her the wrong lemonade that would be an infinitely more sympathetic and tragic tale. But fuck her. If she can get into the ivy leagues she can extrapolate "don't drink monster, don't drink things with MORE caffeine than monster".

The drink has almost 400mg of caffeine in it, I don't know how she was functioning enough after a week of getting them.
