Katz had a heart condition called long QT syndrome type 1 and avoided energy drinks at the recommendation of her doctors

She was very, very vigilant about what she needed to do to keep herself safe

Obviously not since the dumb bitch didn't bother checking what she ordered before ordering it.

Those drinks have something like 350mg/ml of caffeine in them. A perfectly healthy 6'5" 250lb man shouldn't be drinking that, much less a smaller woman with a serious heart condition.

.......just a quick poll on here, as a percentage, how much of humanity do you think would kill themselves due to their own stupidity if we removed ALL safety rails?

My personal guess, 60% as if I knew I had this heart condition, I'd only drink water when I'm out.

It's been 3 generations, maybe 4-5, since natural selection has been at work in the West. "Don't dumb here, this is a no dumb zone" is an edgy workplace sticker now, but in 1950 it would have been perfectly acceptable to post on a business' front door.

I had to share this one because it is a clear Darwin Award, but because a woman did it, it’s a lawsuit.

An Ivy League student with a heart condition died after drinking Panera Bread’s “charged lemonade,” a large cup of which contains more caffeine than cans of Red Bull and Monster energy drinks combined, according to a lawsuit.

Disingenuous opening, most energy drinks don’t have much caffeine, they instead contain egregious amounts of B12

“She was very, very vigilant about what she needed to do to keep herself safe,” Conroy said. “I guarantee if Sarah had known how much caffeine this was, she never would have touched it with a 10-foot pole.”

This is conveniently put at the top of the article because magically at the bottom there is a literal photo of the drink with the exact amount of caffeine per serving right above the pour spout.

The charged lemonade was “offered side-by-side with all of Panera’s non-caffeinated and/or less caffeinated drinks” and was advertised as a “plant-based and clean” beverage that contained as much caffeine as the restaurant’s dark roast coffee, according to photos of both the menu and beverage dispensers in the store, which were included in the wrongful death lawsuit.

And the beverage dispenser lists Caffeine right on the fucking label…

The lawsuit says Katz purchased an Unlimited Sip Club membership from Panera, which allows customers to pay a monthly fee for unlimited drinks, about a week and a half before her death. Conroy said Katz had bought at least one other charged lemonade in the days prior to her cardiac arrest.

So she was either so oblivious she couldn’t be bothered read the sign twice or knew exactly what she was doing…

This is beyond insanity, the fact this lawsuit wasn’t thrown out immediately shows the complete lack of self accountability in modern society, this wasn’t some hidden ingredient, it was a caffeine dose per drink size listed right next to the oz size and calories per drink size, not even per serving…

I'm surprised a restaurant decided to make a drink with that much caffeine, they seem to think high caffeine drinks either have to be coffee or are beneath themselves most of the time.

390 mg is a huge amount of caffeine though.

Pepsi Zero has 69 mg - they had to put more addiction into it because it tastes bad.

Coffee lady all over again. Deliberately misusing a product should completely idemnify the manufacturer as far as I'm concerned. We live in the age where the warning labels are ten pages of an eleven page instruction book for goddamn batteries, and we need to just let the terminally stupid die already.

McDonald's hot coffee? That suit was very low on the frivolity scale. The coffee burned through a thin layer of clothing and left third-degree burns around the lady's groin. She requested only that medical expenses be covered and the corporation was sniffing too far up it's own ass to settle.

Also, she was riding as a passenger in her son's Ford Probe.

Which had no cupholders. And the consequences of the spill were worse; she actually went into shock and stayed at the hospital for a little over a week to get skin grafts.

I don't like the wave of frivolous lawsuits that have come in the wake of that incident; don't get me wrong, but I actually think that the coffee case was handled the right way by the lady and the courts.

She only wanted enough money to cover her medical expenses. The judicial parties got her more money, and the temperature warnings are apparently more prominent on the coffee cups now.

And yet here we are with the implications of that today.

Because if you can take a product explicitly labeled "hot coffee", put it between your legs and of course you get burned but still sue... Then of course you can drink caffeine until you die and still sue the restaurant.

To a reasonable person, "hot coffee" means "ready to drink." It does not mean "if you drink this, you'll die."

If liability can't be waived with clear textual or verbal warnings in English affirmed by customer, sure I'd agree. But "hot" isn't a reasonably unambiguous qualifier for scalding coffee served at a nationwide chain drive through.

I mean in general. If they can give an average nicotine for a cigarette then they can do the same for caffeine and tea or cola. Too many people here just want to jump on the outrage bandwagon at the expense of consumer rights thanks to previous stupid lawsuits.

From the name and not having been in Panera Bread in years I assumed there was some electrical malfunction somehow with the lemonade mixers. This is somehow even more retarded. People need to find that happy medium between avoiding any and all adversity including pushing their own body, and fucking killing themselves NOT listening to "let me fucking sleep" signals. Not quite the case here, but it needed to be said. It is still stupider than the electric issue idea because the bitch KNEW not to drink energy drinks. If the server had fucked up and gave her the wrong lemonade that would be an infinitely more sympathetic and tragic tale. But fuck her. If she can get into the ivy leagues she can extrapolate "don't drink monster, don't drink things with MORE caffeine than monster".
