Can someone tell me if there is any reason to get hyped? I have little faith in the justice system.

I know most of you are blackpilled, but if you are a content creator who was banned from these sites it wouldn't hurt to join. Better to stand your ground than to secede ground.

I ran a small semi-known Youtube channel that had DMC4 vids on it. The account was 10+ years old and it got banned for... comments I made elsewhere. Comments. Why? They never told me what comment triggered it.

Fucking irritating, and if I can get a few shekels in the process drawing blood from the beast, why not?

If the lawsuits amount to nothing [which they likely will], all you're doing is adding your personal details to a list of "dissenters". If [when] they start taking revenge against said "dissenters" like they did with the "capital insurrectionists", it definitely would hurt you to join.

You could argue that you're already in a list somewhere if any of these websites has banned you, but that's still not nearly as "terrifying" to liberals as actually suing them.

Because there is the possibility of getting 230 in front of a Supreme Court that has made noises that they think it's not being used the way Congress intended it to be used.

One good justice, plus one hanger on, making noises and 7 shills.

Calling it now, SCOTUS will decline to hear the case as Pedo Roberts is chief justice.

But right now we've never gotten Section 230 to the SC. We need to do that.

If the SC decide to cuck out like they did with Trump's election, then we know what our next actions will be.

Your mistake is thinking that you should wait until you have a silver bullet case.

That's not how this works. The court system is not Sniper Elite. It's Dark Souls.

You just aren't aware of the hundreds of cases that are blasted at the courts every year on guns and abortion with the aim of getting a couple that actually sink in.

That is what it takes to effect change through the courts. Using infinite funding to put a continuous stream of cases in to the courts until you get a good one.

Nah, I doubt it will succeed but do commend him for at least trying. The left uses lawfare like they breathe. Even though most cases are thrown out, the few that stick have consequential effects.

He can't even get a proper vote audit on a federal election, nobody should expect that he would be able to do anything to the information control centers. If this is anything, it's purely to try and drive public support.

Good. Always hit back. A class action suit against them all is long overdue. They have stolen the public square and declared it the property of Marx.

property of Marx

which would be hilariously ironic if all marxists weren't know to be massive hypocrites about the whole property thing

As president he could at best proposed alteration into good Samaritan law (which contains problematic and arbitrary clause of "otherwise objectionable" which enables SoMe platforms with their fascists' term of services); other ways would have been dangerous presences if not overstepping boundaries, and unlike democrats Trump knows not to create weaponry that can come to bite you into ass on next round

The orange buffoon could have moved over to Parler back when Parler was still relevant. That and banning federal agencies from using Twitter would have been a massive blow to Twitter.

moved over to Parler back when Parler was still relevant

How on earth would that have helped? Even if it dealt a blow to twitter they'd be back to normal by now, and Parler would still be dead. (having banned him to comply with Apple and Amazon)

▲ 7 ▼
– elleand202 7 points 4 years ago +7 / -0

It would have forced the press onto Parler. Twitter essentially has two user bases, twitter leftists and politicos/the media/establishment. Trump would have dragged the press and other Republicans onto Parler, and with them, all the TDS suffering leftists probably would have opened accounts as well in order to dunk on Trump. That would have created enough of a critical mass that Amazon would not have yeeted Parler for fear of the backlash. As it was, it was only a group of conservatives using Parler and Amazon doesn't give a single fuck about taking down a platform that only conservatives use.

Also for the courts to take you seriously you have to show harm. Parler wasn't a realistic alternative, but opening an account would have been seen as an admission that he believed it was - giving them an excuse to dismiss the case.

This suit will go nowhere. These platforms have been sued by many others over the past few years for a variety of reasons including free speech, censorship, etc. and they've all been shot down in court. Here is one such example. This suit is a publicity stunt to rally the base.

100% a stunt to squeeze more donations out of his gullible base. Grifters gonna grift.

technically could also have issues: no public authority or person working for public authority may use social media, but how'd ya think that would have resonated in voter base that believes in "freedom" ; no, only solutions would be 1) alter that cursed point in law and make social media companies also able to loose their platform status if they do not stay as platforms (that would been major blow if any) or 2) divide monopolies

"No Executive Branch Office or Employee when acting in the official capacity of their position, shall disseminate any communications -- official or unofficial -- over the social media platform commonly known as Twitter"

Use of electronic systems by government offices and employees is restricted all the time: they don't get to install whatever software they want on their government issued computers.

Honestly it would be good to extend that rule to all government officials on all media platforms. When did we get to a point where everyone @FBI @USARMY @IRS @NASA @USHOUSE @USEMBASSYINNEPAL are making their own random statements about whatever they want? Shouldn't all government communications be disseminating from a single source or at least be approved?

I first noticed the phenomenon when @FBIPortland quickly tweeted an official statement (before they could have even started any investigation) that "there is no group setting fires on the west coast, that's just a conspiracy theory, so please stop calling the police to report that you saw someone setting a fire."

Here are the actual lawsuits in case anyone wants to read them. Trump v. Facebook, Trump v. Twitter, and Trump v. Youtube. The TL/DR of them is that Trump is alleging that he and the various co-plaintiffs were removed from the respective platforms at the behest of various government actors (including Michelle Obama and the CDC) in violation of the First Amendment and that these tech companies are using § 230 as cover.

Legally, its not a bad argument. However, it is going to be very hard to prove and because these suits were written so broadly, its going to be hard to survive summary judgment or possibly even a 12(b)(6) motion. All bets are off if it gets to discovery however. In particular with the COVID censorship, I bet that there is evidence of censorship on behalf of the government by those platforms.

The Twitter and Facebook cases have been assigned to Obama appointees and the Youtube suit has been assigned to a W Bush appointee.

Exactly. All the generic “free speech big tech censorship” stuff will just be shot down as it has multiple times in the past. I also think that the argument that YouTube, Facebook and Twitter were goaded by House Dems and Michele Obama into censoring users probably won’t fly either.

I do think that the best argument that they made is the one that these companies worked with government agents to block specific topics. We know that this happened thanks to the Fauci emails. I also don’t think that this has been litigated before. However, it’s going to be very hard to prove and that may be the suit’s downfall.

But ultimately, just like you said, they’ll just stop working so closely with the federal government since they like banning the same people and topics anyways.

It amazes me that in seven years all of #Gamergate never found a lawyer to file an antitrust or RICO suit over the mass banning from multiple websites and the DDOS attacks against sites discussing Gamergate. Nobody had a lawyer or a cop in the family who could do something about it. Everyone who has been banned from somewhere should gather their evidence and try to join Trump's class action.
