Your suggestions would be golden on a board full of honest actors. Unfortunately forums like this one attact all sorts of dishonest actors whose entire purpose is to derail discussion: sometimes feds, sometimes fifth-columnists, sometimes just extreme autists looking for an echo chamber where they can have their own ideas reflected unquestioningly back at them. Such people can't just block and move on because they're only here to drag us all down into the mud with them.

Here's the thing: Imp constantly goes out of his way to argue with the stormfags and piss them off, so contrary to their plaintive, hand-wringing demands that they should be allowed to say whatever they want about their own target groups, they will immediately start reporting every comment Imp makes in order to bring him to Dom's attention and get him banned.

DoM doesn't go around reading every thread: he responds to reports. Those of us who are actually principled, unlike the stormfags, don't go around reporting all of their nonsensical tin-foil-hat Jew-baiting statements. If we did, many of those users would be gone just as quickly as Imp. The fact that so many of them are still here is simply a function of their own hypocrisy: they will hide behind free-speech principles at the same time as they go out of their way to get people who disagree with them banned, even if that person is harmless as Imp, because they are incapable of arguing in good faith.

The bar that SCOTUS has previously set for protected vs unprotected speech is that your threat must be realistically actionable in order for it to qualify as a genuine death threat, just as incitement to violence is only criminal if there is a realistic possibility that someone might actually act on your words.

Threatening to kill hypothetical individuals on a hypothetical list that official sources all insist is not real does not seem to meet that criterion, but we'll see if the courts try to walk it back.
