A hilarious thought occured. If Burgerking indeed never sought McDonalds' permission for this, it could indeed be copyright infringement. As I understand it, if an IP holder doesn't pursue legal recourse, other infringers can point to the piece and say "they were fine with it there" and legally use the copyrighted material in the same manner.

If McDonalds attack the ad, even on trademark grounds, they'll be seen as homophobic. Ronald McDonald is a far more central part of McDonald's branding than the The King is for Burger King.
BK doesn't have much to lose, even in conservative areas, from people thinking their mascot is gay, because BK don't have life size statues of the king at half their locations.
But McDonalds do, and parents will watch their kids sit in the lap of a clown who's gay on twitter. Meanwhile, at Burger King, parents will seldom encounter the gay king.
So yeah, you could totally interpret this a 4D chess kafkatrap.

The Ronald McDonald of my childhood was a black man in whiteface.
It was considered really "woke" at the time to crow about this to kids, while sitting them down to watch Fat Albert or Good Times.
I thought they already stopped more or less using their mascot because of the modern unpopularity of clowns, and the fact that they morphed from circus and birthday fools to horror icons.
As I said somewhere before, it's kind of shocking to realize that Krusty the Klown is the closest thing left to the traditional clown in modern pop culture, and he was intended to mock the traditional TV clown (particularly Bozo and his franchise.)

I mean, it's literally a message. I don't see why all the people in this thread are are jerking eachother off getting all angry about it.

If BK or McD's put ads in The Advocate, or in a gay neighborhood, with gay or lesbian couples sitting in their restaurants doing cute PDAs (like playing the Pocky game, only with a french fry), I would not mind one bit.
Imagine a pictorial ad with a man and a woman taking kids to a fast food joint. You have no idea where the kids came from. It's not relevant. For all you know, that's not a family, that's a guy and his female (platonic) roommate, or girlfriend, taking the neighbor kids who raked his yard for $10 out to a restaurant as a thank you for doing such a good job.
That's because SEX IS NOT THE POINT OF THAT AD.
Even the first ad I mentioned is not sexual because you don't know they're gay. It could be two straight guys acting out a dare, or two straight girls. SEX IS NOT THE POINT.
Given that advertising works best when the person seeing the ad can project his own psyche on the ad, this is a good general rule to follow.
The BK ad above is breaking all those rules. Sex is the point. And it is political pandering, pure and simple.
