In their eyes what Penny did was worse: he dared be White and interfere with a negro's whims. However, since that isn't a crime, yet, they are charging Penny with murder instead.
Well for the cops, its less that they give a shit about the negro and more that he tried to take the law in his own hands by standing up for himself.
That's the kind of thing cops, especially NYPD type cops, hate. They are supposed to have the monopoly on violence, control, and defense. Him doing what he did might threaten that.
The NYPD was created to beat the shit out of rioters and make that shithole of a city somewhat attractive for business. Any "protecting and serving" it did for the public is purely coincidental.
Police footage shows that he still had a pulse when police arrived. They are also on record of not wanting to do mouth-to-mouth, cause the guy "looked like a drug user" (no shit).
But it's interesting that this kind of information is only released now. Not like they could've mentioned it back then - they really hoped a St. Floyd 2.0 summer of peace would've happened.

Okay, now we know why he's ACTUALLY being charged. The NYPD and EMT's don't want to admit they accidentally let a guy die from Cardiac Arrest.
This is literally the same shit that happened to Eric Garner back in the day. A blood choke was applied to a resisting suspect who weighed damn near 500 lbs. He stopped breathing after the choke was released, after he was hand cuffed, and after the cops got off of him. However, the EMT's, basically let him lie on the ground for several minutes, preforming zero life-saving efforts to him in any way. They saw he was unconscious and that his chest wasn't moving so they just stood and looked at him until he went into cardiac arrest and died.
The cops didn't kill Eric Garner, the EMT's did.
With this guy, what the EMT's didn't want to do mouth-to-mouth despite having multiple ways of getting air into a patients lungs without putting their lips on him.
Chest compressions are so much more important than mouth ventilation that it's not really recommended anymore.

This was obviously the case in the moment. He clearly let the choke go loose when the guy complied / stopped fighting. Since his military service record is being used as a weapon against him by the prosecutor, his basic combatives training would have taught him to do exactly that by mere repetition with training partners.
This is why applying a blood-choke to someone should not be considered potentially deadly force simply because it's being applied. It could become that, but it isn't necessarily that.
Wasn't it the LAPD who found the choke hold was non-lethal on whites but some artery differences on blacks made it fatal? So they stopped using it, leaving four officers no choice but to use clubs to subdue Rodney King...

I'm definitely on Penny's side on this, but the assailant having a pulse after cops arrived on the scene doesn't mean that much. If you're found to have caused the death of another, even if that death is delayed, you can still be liable. Homicide doesn't have to be immediate.
It shows a lack of mens rea and pre-meditation; the prosecutor is assuming both of these things for the murder charge Penny is facing.
