close inspection of the video shows the shooter initially turned around after "he's got a gun", which morphed into "Gun Gun!" at the time he started reaching for his sidearm. the video above shows the shooter started reaching before the sound of the first gunshot. in fact, the video shows the shooter reaching for his own sidearm at the precise moment the agent in grey initially grabbed Pretti's gun in it's holster well before the first shot.
I haven't been able to find any footage where the slide of pretti's gun is anything more than a blur though.

Pretti physically intervened. while he did put his hands up, he still inserted himself between the officers and the agitators. This is grounds to detain him. Pretti was being stupid.
While detaining him, one ice officer yelled "gun" and within seconds the first shot went off. "Gun" was yelled even though both of Pretti's hands were secure. he did not reach for his waistband until after the first shot went off. practically speaking, Pretti's gun was removed at the same time he was shot, the agent firing the shot could not reasonably know that the gun was no longer in play. The ICE officer who fired the first shot did not draw his gun until after another officer yelled "gun".
after the first shots were fired the rest of the agents backed off and fired more shots into Pretti. this seems to be more of a result of hearing the shots being fired, rather than the officers observing any aggressive behavior from Pretti.
