Hell, there's still an argument about how the gun got out. Robert Barnes claims the shooting is unjustified because he's under the impression that an ICE agent removed the gun. But there's no clear evidence to support that yet, as the gun got picked up from the ground. It looks like the suspect tried to draw something from his back, which might have been the holster, which I still can't confirm.
If the situation is that the suspect was attempting to draw the gun, but it got dislodged, and the gun fell to the ground, and he ended up drawing his holster because he still thought he had a gun in it, it makes the whole shooting 100% justified.
