The decision from U.S. District Judge Fernando Rodriguez, Jr., a Trump appointee, is the latest sharp rebuke to one of Trump’s most aggressive and high-profile efforts to quickly carry out deportations with little or no due process.

These retards keep spewing due process like they need a court appearance for due process to be achieved. It only means they get treated fairly under the law, which can be as simple as “we can prove this person is currently here illegally, have the documents filed, and now we’re deporting them”, this magically is how deportations occurred before Trump, Obama deported over 3 million illegal immigrants with nary a peep of “due process”.

Rodriguez said Trump had improperly invoked the law — which gives the president the power to quickly expel nationals of invading countries — to target alleged members of a Venezuelan gang, Tren de Aragua.

Rodriguez didn’t bother reading what Madison considered an invading force. Pirates, bandits, and brigands all were considered an expellable “invading force”. But it’s 2025 so fuck the founding fathers right?

The Alien Enemies Act applies only when the country is facing an armed, organized attack, Rodriguez ruled. Trump’s claims about Tren de Aragua’s activities in the United States fall short of that bar, the judge added.

Which is literally happening, how fascinating he actually admitted that it does apply but I bet he said Tren de Aragua “was just an idea”. Leftists will argue semantics on “organized” because they know it’s a malleable term.

“The Proclamation exceeds the scope of the statute and, as a result, is unlawful,” Rodriguez concluded. “[Administration officials] do not possess the lawful authority under the AEA, and based on the Proclamation, to detain Venezuelan aliens, transfer them within the United States, or remove them from the country.”

It doesn’t, a judge making proclamations about at best an argument over what constitutes “organized” is why legislation from the bench was so effective when the Warren court started it and has continued since. At this point the judiciary needs to be kneecapped with extreme prejudice until they stop pretending they are arbiters of the constitution.

By this logic it wouldnt have been legal to expel any members of the taliban before they took over afghanistan because it wouldnt have counted as organized? We cant deport them as invaders unless a government declares a war and claims the invaders? and obviously at that point you shouldnt be deporting, youre just killing if you have any sense

Multiple USSC precedent holds that the Executive holds almost unilateral authority when it comes to immigration, but this doesnt seem to have reached the district level.

These courts are rapidly squandering any legitimacy they might have. They have no enforcement mechanism for their rulings, by design, and their rulings are complied with at the discretion of the executive branch.

There's an idea of "legalism" where the letter of the law become more important then the spirit of the law, and you shift to rule by lawyers and judges. Once you start having written laws that stem from liberalism you end up with this as a function of time, as case law itself has a used by date as more and more "laws" pile up. The answer is to return to a more "unfair" law system that relies on the spirit of the law. "What would a citizen in good standing do and be expected to do" as the test for whether something is a crime for example.

It's an idea you're going to have to start thinking more and more about because the system of "take dispute to people to argue over the arcane complexities over the meaning of individual words to decide the outcome" may as well be witch craft to the average person.
