Who the hell is running FOX? There is absolutely no chance they win this unless Twitter has a paid contract of some sort with Tucker which I seriously doubt.

I agree. I'm not sure what his contract states, but I don't think he's working for anyone at the moment. I don't even know how he makes money off of this unless Twitter is already paying out content creators with ad revenue.

if you signed a non-compete, he could still be providing a competing product even if he doesn't monetize it. It depends on how the non-compete is worded, how much Fox is willing to spend on lawyers, and how well they can bribe the judge.

If personal social media posts on Twitter constitute 'news' that would mean social media now be held to the same standard, which would legally open them up to all sorts of problems.

Twitter does not want to be an official news source, it is social media. Fox is just trying to suspend Tuckers show, they have no chance to win this lawsuit.

Fox is in panic mode because their ratings are dropping, and they're upset that Tucker is unfazed by the separation. They have a mindset of "If we're going to fail, so will you." This is what they get for firing their breadwinner.

Unless they do it from a heavily politicised district like LA or NY (and even then it's a 50/50 as they'll be deciding who do they want to fuck over more, Tucker or ALL of Fox) this is not going to go anywhere and is even going to be a win for Tucker as I believe his lawyers have already been on the move about a breach of contract thanks to the 'leaks' that happened on him shortly after he left.

This is the temper tantrum from an old defunct model of media as Tucker with 1 episode got more views than ALL Legacy media combined for an entire week.

FoxNews decided to take out Tucker, most likely because of the upcoming presidential elections. Everything is about the election cycle. By removing him now and holding his contractual obligations against him, his impact on the elections will be sharply reduced. That's why they're threatening to sue him over his 'twitter show'. They just need to shut him up until the elections are over.

If his lawyers actually responded with the free speech argument then he needs to fire those lawyers and get actually competent attorneys. It’s well established that you can contract away your speech rights. People sign NDAs every day. What actually matters is that Tucker’s contract likely has a carve out for his Twitter account and that’s why Tucker publishes there. The Fox lawyers probably know this but are probably desperate to get him to shut up.

If I were Tucker, I’d welcome a lawsuit because it’ll likely spell the end of his FNC contract.

They can argue more than one point in pleadings. Which is a better headline though: "Tucker Carlson argues free speech" Or "Tucker Carlson argues explicit terms in contract"?

Sure and in all likelihood it was an unserious legal argument that was instead intended to make headlines. But I’m cautious because I distinctly remember some of Trump’s lawyers making some of the worst arguments in this same style; arguments that had zero legal merit and they were unceremoniously BTFOed out of court.

These aren’t pleadings, it’s a reply to either a Cease and Desist letter or a Demand letter, depending on how the Fox lawyers wrote it.

He’s not fired, they just canned his show. He’s still on payroll and thus they can still control him.

Normally when your show is canceled, you’re also fired. But in this case, Fox wants to handcuff Tucker by paying him and thus still be contractually obligated, so he won’t jump to a competitor.
