Because none of them drove the car which hit her. They dropped her off at an apartment complex, presumably near where she lived, and she was struck by an uber driver while wandering around.

The article says "they later dropped Brooks off at a nearby subdivision". That's not the same as "abandoned on a highway."

Ok but murder has specific requirements in the statute. I know in Clown World we now just prosecute people over feels and the latest two-minute hates, but that's the technical reason. The DA did not think he could prove that those legal requirements were met.

I don't know the specific language in this state, but what I asserted isn't exactly far off. If I dump you dead drunk somewhere where you have no idea where you are, and you end up dying hit by a car, that is murder in my jurisdiction - and rightly so.

I don't know if LA has a felony murder rule or not - if so, the prosecution could choose to pursue that angle.

Kicking her out of the car on a freeway is a Murder I charge. Dropping her off on the sidewalk would be manslaughter at best, unless the State can charge them with her death in the commission (cleanup) of a felony (rape).

The Felony Murder concept is bullshit, anyways. You are responsible for the consequences of your actions, not those of other people.
