So I'm supposed to feel bad for "Levent" who sounds like a complete nuisance to the rest of the students?

I've worked in education. I know exactly the type of kid "Levent" is. It just takes one Levent to derail an entire classroom. Plenty of kids with ADHD don't fight other students and skip school. Slapping a label on his behavior doesn't excuse it.

Precisely.

When schools discipline a kid with document “disabilities” (and yes, I am skeptical as hell about this term), they have to do something called a manifestation determination. In essence, this process, often with a psychologist or other specialist, determines whether the misbehavior was due to the kid’s documented disability.

Like you say, ADHD does not mean fighting, stealing, insulting teachers, or whatever, is acceptable.

It sounds like the school went through a manifestation hearing. They followed the stupid bureaucratic paperwork. They determined the kid’s disability did not play into his behavior. THey punished him.

I can see why the parents are confused. Public schools are notorious for letting kids do just that using their disability as an excuse. It seems the only reason this kid is being held accountable is because it's a charter school that's exempt from a lot of the nonsense that public schools have to put up with.

Yes and no. In all states that I know of, public charter schools have to follow the same rules regarding disabilities and punishments that traditional public schools do.

I think the biggest difference is that many public school districts give up--they figure it's not worth fighting these cases, cause the kids are just going to come back year after year. So you just pass them, graduate them, and they're no longer a problem.

I know plenty of public school (and charter school) teachers and administrators who would love to be able to do more, but the legal system has completely fucked them over. Just about any punishment can and will be challenged on the basis of "disability" and--often at the same time--racism.

It's a nightmare, and the root of the cause is the legal system.

True, but at the same time....boys do benefit from structure. No structure leads to immense stupidity and nothing getting done, which is one of the reasons why our current system is failing so badly. Especially because 1 particular demographic is allowed to do whatever they want to do, no matter how destructive.

The "lowest common denominator" is NOT a good way to teach children! Making sure the dumbest kid in class learns stuff is one thing, that's fine. Designing the whole curriculum to accommodate him is NOT!
Teach to the average kid's ability, that may vary from class to class. The smarter ones get some extra challenges & the dumb one get extra lessons.
Acting like the whole class is filled with idiots is where the Teacher's Union is today: they will fight against actual teaching with all their might.

Here in Canada they try to "integrate" literal vegetables into regular classes. They cannot read, write or even speak. But there they are! Disrupting the class all day long with a special handler assigned to them at great expense. They cannot even feed themselves, feeding tubes are required. 😧

Society will be paying when the people who didn't do shit about it today, later will get their just rewards when they are in the nursing home left laying out on the floor for hours or given the wrong medication because their caretakers are unable to read "big words."
