( What actually happens : Nintendo is now ruled by ''monetisation experts'' who did extensive market studies on how to extract as much money as possible from costumers of each country. They don't aim at the market of people who would only buy it at $300 to buy 1 to 3 games new only and the rest second hand, and not pay into subscription services.

I actually think Nintendo will win this particular case, since the Supreme Court ruled that Trump did not have the authority to implement the tariffs the way he did. Nintendo was subject to those tariffs.
Oh you mean the same Supreme Court that ruled no standing on election fraud.
I'm not saying the ruling was correct, I'm just pointing out the legal landscape that this suit will be processed under
they ruled using emergency powers to implement tariffs. not the rest of it. hence why that ruling was a nothing burger.

Nintendo is litigious, this shouldn't be news to anyone. Look at Palworld. Or Pokemon Uranium. Or anyone who wears a large hat that's a bit too red. They LOVE suing.

which were the tariffs Nintendo was paying, hence why they will likely win.
I always liked Nintendo and Mario games and thought they mostly kept the games clean, fun, and friendly for children. So i back Nintendo. I know they are hard on torrents and hackers and sue often and use cutting edge methods to try to protect their intellectual property. Not sure i support everything they do but overall i think Nintendo brings lots of joy to kids and didn't make everything gay and jewed.
EDIT: That extends to other japanese products. I like their audio equipment, musical instruments, electronics, automobiles. I like Toyota and Honda cars trucks dirt bikes. I like Yamaha. I liked japanese akai and technics and panasonic. Sony? Just good stuff overall. Even when you get down to the electronic components, such as buying capacitors, the japanese branded ones are most trusted and have higher reputation. I have some love for my Imperial Japs.

Seeing as these tariffs were in large part immediately replaced by other tariffs levied through a different methodology, they should force them to drop this suit by saying they will raise their new tariffs higher to specifically recoup the money should they win this lawsuit.
Just for the hilarity factor, a retaliatory 'make rom preservation fully legal' in USA regardless of how old or new the game is law should come into effect.
