Prosecutors in Colorado plan to drop charges against a registered sex offender accused of trying to kidnap a child from an elementary school because he was found incompetent to stand trial.

The 33-year-old faces one count of attempted kidnapping after he allegedly tried to take an 11-year-old boy during recess at Black Forest Hills Elementary School in April 2024.

After his arrest, Galligan underwent a mental competency evaluation that determined he was unfit to stand trial. As a result, prosecutors claimed they have no choice but to drop the charges.

School district officials conducted an investigation, where former Black Forrest Hills Elementary School Principal Amanda Replogle was replaced, the outlet reported.

Being considered unfit is an arbitrary bar that can come and go depending on all sorts of subjective nonsense. Its basically a "temporary insanity" defense for most who use it.

I mean, the entire point of having that exception was "so toss em in the psyche ward instead of prison." So that they are either made competent enough to be in society (getting a schizo medicated) or they are put somewhere not incredibly cruel for a retard (those who can't be made to function).

Problem being, we gutted psyche wards and activists judges are taking the first half without the necessary followup.

Aren't we glad the supreme court ruled that people like this can't be prosecuted?

People cry more over a fictional Lenny from of Mice and Men than they do for real victims.

Be glad defense is still allowed in most states for situations like this.

I cry for Lenny because he was a good boy who had to be killed because a worthless woman was big sad about her life and walked into a dangerous situation to be a thot.

Most "real victims" I'm told to cry about are the same type of retarded woman who gets victimized after doing something stupid they should know better than. Or niggers getting the consequence of their own action.

As I recall, the book starts with Lenny and George already on the run because Lenny tarded out on another woman before, grabbing and tearing her skirt because he thought it was perty. He also cannot be trusted with small animals because he squeezes them to death because he cannot figure out that he keeps squeezing them to death. True, the woman was not wise, but Lenny being a problem was inevitable.

He is a large man meant for manual labor, a place where women shouldn't be around to begin with. Have his wrangler near him to help prevent as many small animal deaths as possible and he can live a fulfilling and productive life just fine.

The book made it quite obvious that the woman kept coming around to start trouble, and no one who wasn't blinded with lust wanted her there. Her death is entirely her fault and is far beyond just being "not wise."

It was inevitable because of the evils of the world that surrounded them, but that's why his fate is a tragedy instead of a necessity.

The sheer amount of rules about psychiatric holds out there right now make them basically useless and so strict that you can't put someone in easily until they've actually killed someone.

Its one of those double edged swords, where you can't let it be too loose because then "he voted for Trump, he is psychotic!" becomes the norm to just lock people up, but then you have all the obvious cases like this where they we can all see they should be.
