Maybe the Piney Grove Baptist Church should have maintained ownership of their cemetery if they wanted it maintained. They are the ones that chose to disrespect the dead they were entrusted with so they could gain more of things that which are Caesar's.

The plaintiffs themselves had been to the cemetery when they were children and had not been back in years

So these honored ancestors that you are so distraught about didn't matter to you for 60+ years, until you saw money as a possibility.

They space out all the relevant bits with as much white guilt wringing and anti-capitalism as possible because they know that it would tank any sympathy they might get because it shows a complete lack of giving a shit.

What's funny is that it has all the pieces necessary to make me side with them. An HOA and selling of land to a "developer" to make luxury townhomes with the "promise" to maintain something. Yet they still managed to put me on the side of the HOA.

At least Floyd's kids had the weak excuse of the "tragic circumstances" of his death bringing them back. Even I cared somewhat more about my dad once he reached the end of his existence.

This is a grave that has been slowly rotting for generations. Nothing brought them back to it other than the cause of money.

If someone demands money because they think my ancestors owned slaves. They very much didn’t, but I’ll gladly look them in the eyes and say “but I really wish they did own slaves though, and I hope they would’ve beat the fuck out of your great great grandpappy knowing now that your dumbass would eventually exist”

They also won't let anybody move it, cuz reasons. So I dunno how this thing can be maintained unless volunteers schlep their way to it. And it sounds like the HoA is doing their part providing access.

The HOA won't - probably shouldn't - let them do that, as they'd then be liable for any accidents or incidents on the HOA's land in the course of cleaning the place up.

Ugh I hate HOA’s. Anyway, the descendants won’t allow the cemetery to be moved, and, frankly I don’t see how this is the HOA’s problem. The developer made those promises. The home owners could dissolve the HOA tomorrow and then what? Then who will maintain it?

The HOA can do literally nothing with that parcel of land other than pay taxes on it. What they should do is just give the deed to the cemetary to that family and let them deal with it if it’s so important to them. They’d really be losing nothing by doing so, other than the tax burden.

I don't know if it's possible to not have some kind of government when you live in condos. IDK exactly what they built. I didn't check. But a lot of new housing is attached, everywhere.

I don't know if there is a mechanism to have the HoA on the hook for the developers' promises or not.

Eh, take race out of it, and it's a simple breach of contract case:

The Atlanta City Council approved an ordinance for “the requested development provided that the developer met the maintenance and access conditions,” the complaint states, arguing the responsibility for maintaining the cemetery lies with the HOA.

If the HOA got zoning permission to develop the adjacent property into townhomes contingent on their maintenance of the cemetery, the city council simply needs threaten to re-zone the area back to what it was. I'm sure they'll find a way to clean it up pretty quick when all those rich homeowners start filing lawsuits against the HOA/developer because they're in danger of losing their houses.

I'm fairly certain there's no way Georgia law would allow seizing of homesteads. it's very hard even for eminent domain. i should say as far as people's houses. Nobody lives at the cemetery, so they could seize that. The protections apply to people's homes.

This actually has a basis totally divorced from race. If part of the conditions for rewriting zoning laws to allow your subdivision to be built is that you have to maintain the cemetery you purchased, then it's pretty clear. The HOA doesn't want to honor the conditions that came with the land. Frankly they're getting a taste of their own medicine.
