The mechanism would be by Republicans getting enough votes in Congress to impeach him. It will be at least another election. Which means Biden himself would have to get re-elected, I think, before any prosecution could go on.

The FBI is under control of the DOJ and constitutionally they can only act with some "involvement" of the President. The advise and consent clause doesn't give allowance for an independent police department / investigative agency run by the federal government. I'm not excusing Biden. Just saying the whole lie of "I didn't approve the raid" never made any sense as plausible deniability except to an uneducated electorate. The media has always pushed the lie of independent investigations either to grant cover for their favorite presidents, or pressure the unfavored ones into letting FBI ops run unchecked.
He claimed the White House didn't know about it though. Which is a possible thing that could happen. The FBI can act without telling the President, or anyone who works for him directly, anything. In fact, I would think they mostly do operate that way.
