Thomas has been a true champion for judicial restraint and minimizing government power grabs. A true hero. I wish Scalia was still around too.

At the other end of the spectrum, what an awful jurist Sotomayor is. She is the embodiment of politics taking precedence over law and legal knowledge. I know law professors who have privately told me that she's an embarrassing idiot. What they said basically was "Well, she's an idiot, but at least she's our idiot."

When Griswold went through, people were concerned that the same logic could be used to legalize abortion and they were told that wouldn't happen. Less than ten years later that happened.

Now, people are concerned that the same logic used to overturn Roe could overturn the entire sexual revolution, and they are being told Yes. Let's hope that happens.

Is this a joke? Miranda rights are a joke established by the warren court which has thrown out numerous cases of clear guilt because rights were not immediately relegated properly. Tell me, is it more rational for a person to understand their rights immediately in the moment of arrest or during processing? A rational bill would exclude all personal statements without a defense attorney present are not viable during trial. This defends the accused from the state abusing their rights to make a confession while allowing the state to properly detain people in high risk situations without worrying more about process than the safety of those they detain and themselves? The warren court was a travesty that established federal control over states in extremes that was only rivaled by the civil rights bill shortly before.

Thomas is 100% correct as a matter of law. The role of the Supreme Court is not to legislate from the bench.

Griswold, Lawrence, and Obergefell are all examples of legislating from the bench. The proper and correct solution on those issues should have been political action taken by legislatures, not the Court invoking the Constitution where it did not apply.

Add that absolutely travesty Bostock to the list, too.

What moral high ground? That of standing by stuff that was made up? That is not the job of the court.

All of these have a small negative effect on birth rates compared to the giant elephant in the room, but nobody's touching women's legal privileges over men.
