Who poses this risk to the site as a whole? It's as legal to display a swastika as a hammer and sickle, in the US. And the people who would shut down a site for a swastika would shut it down faster for Donald Trump.

It is not really about legal or illegal. There is plenty of stuff that is legal, but which poses a severe risk. E.g. the Daily Stormer did nothing illegal, but registrars and hosters did a number on it.
