I've noted that for coverage for an incident that is an accident like the driver losing control, media will usually say a driver lost control. For intentional acts they pull the car did it bit.

I need to watch the video, but if he had a gun and was running into a building that wasn't his, it meets all the legal justifications to shoot him, whether he was firing or not.
