The last hundred years of case law literally only stipulates that because someone is buying a physical product it doesn’t count as gambling. there is a guaranteed payout (you bought “a pack of cards” and you got “a pack of cards”). The exact same scenario applies to loot boxes
alternative value/functional use (you can play Pokémon with your Pokémon cards as opposed to just reselling them). The exact same scenario applies to loot boxes/skins
no cash payouts. All value resides in the secondary market. Again, the EXACT SAME SCENARIO APPLIES TO LOOTBOXES.
