there is a guaranteed payout (you bought “a pack of cards” and you got “a pack of cards”). The exact same scenario applies to loot boxes
alternative value/functional use (you can play Pokémon with your Pokémon cards as opposed to just reselling them). The exact same scenario applies to loot boxes/skins
no cash payouts. All value resides in the secondary market. Again, the EXACT SAME SCENARIO APPLIES TO LOOTBOXES.

Every single case revolved around the fact that physical cards were sold as the product. Your point one is exactly what I said. The court ruled buying a physical product is not gambling. This is despite courts also ruling that buying gambling chips for the purpose of doing the exact same thing is gambling and children are banned from buying gambling chips. It’s almost like courts aren’t rational.
You can also use gambling chips to play checkers, it doesn’t nullify market value.
