I'm sure they paid for a license. The US gov't is not going to get charged with IP theft. ICE is flush with cash after the BBB.

America has hit some (D)rug Traffickers with missiles and doesn't give a fuck. Nintendo is stupid, but not suicidal.
I don't think the pokemon theme is a thing you can license.
Of course Nintendo has a license to it. But they don't get to stop Fair Use for parody.

See the nice thing about being a sovereign is that you can just choose not to get sued. They would have to point to a law that allows them to sue the federal government. Maybe the federal tort claims act? The FTCA has a lot of restrictions. I don’t think the standard laws on IP infringement applies to the feds.
