It shouldn't be, but it can' be considered a hate crime if you are attacking people because they are jewish.

Unironically, yes. That and how well the prosecution can stack the racial makeup of the jury. Which is why "hate crime" laws should never have been allowed in the first place.
Where is the lie? That's the point. Guilty people lie, you don't have literally any evidence that a hate crime took place. You don't get to make-up shit because it makes you feel better.
