I have a feeling had that happened the argument would instead be that it should have been filed where the company was, as is the actual case. This is desperation tactics and grasping for any straws possibly while simultaneously trying to conjure up said straws in the first place.
A defamation suit against a brand they don't even own anymore. I'm sure that lawyer is not particularly excited about this one. They will likely settle, but they may as well drag it on as long as possible especially considering Deadspin isn't even a going interest.
