Standing pretty much never not bullshit. At least when it comes to high profile cases. Another means for the system to avoid inconvenient cases.

It's particularly egregious here; they've created an impenetrable shield around government censorship:

1 - You can't sue the government because you haven't proved that they censored anyone. First you have to sue the third parties who did the censoring.

2 - You can't sue a third party for censorship because it's not illegal for the third party to censor.

3 - You can't sue anybody.

This right here. Without going into explicit detail, I was part of a case against the federal government thrown out because there wasn't standing yet (even though the negative impact, or harm, was imminent, it hadn't happened yet). After the government took final action and there was clear harm with no further recourse, it was thrown out again for Cheveron deference (the court has to defer to the federal agency that wronged you because they're the "experts," and of course the agency you're suing is going to say they're right).

It's next to impossible to sue the government, because you need to carefully stand up dominos to make the perfect case, and then have pockets deep enough to roll the dice on taking the case all the way.

There are four boxes. Third is "jury". When do we start using the fourth and last box?

They're cowards. Afraid to rock the boat by actually following the law for once.

The judiciary is every bit as much a part of the problem as the media. They are not going to be part of the solution, but targets if it.

fuck this country

Nah, fuck the people we've allowed to ruin it. The framework is still great, we just have a bunch of traitors ignoring and subverting as they please.

if our states don't have "standing" to stand up to the federal government

They do have standing, our justice system is simply on the very long list of traitorous and/or cowardly assholes.

The framework allows traitors to ignore and subvert it, so it's hardly perfect. Good thing article V details how to change or replace it, so barriers to subversion can be added if we ever manage to take our nation back before it burns to the ground.

The founders knew that snakes would figure out how to subvert it, there's no such thing as an uncorruptable system.

The enormous power of the feds is why the Battle of Athens can't happen today. We're supposed to have the 2A as the eject lever in case all else fails, but the corrupt snakes destroying everything have the world's best military, intel agencies, and militarized police protecting them from their own constituents.

Turns out once gov officials are no longer afraid of ending up in a ditch or swinging from a tree they wipe their ass with the Constitution.

Also note that the left never gives up no matter how many suits they lose. e.g. no matter how many times SCOTUS affirms the 2nd amendment they just keep attacking it.

Meanwhile the right gets one loss and immediately gives up. e.g. Obamacare, Gay marriage. States should just pass laws saying no censorship period and let the feds come after them. Every red state should pass a law TODAY fining social media companies for censorship. But they won't.

they also rejected the CHD lawsuit against the emergency authorization for the clot shot due to standing https://www.zerohedge.com/medical/supreme-court-turns-away-covid-19-vaccine-appeals

Correct me if I'm wrong, but this would hypothetically mean that Elon Musk could be seen as having standing by complaining that X was/has been pressured by the White House.

he would probably have to prove that the White House was directly involved in his social media issues.

I'm pretty sure that's a miniscule leap. Musk has already talked about the White House involvement with Twitter before and around the time of releasing the Twitter Files.

Standing is how they evaded the lawsuits surrounding the 2020 election, and then the mainstream "right" parroted the lie that the suits were thrown out due to lack of evidence since they wanted to appear "moderate" and "reasonable." Which of course only strengenthed the framing of 2020 being stolen as an "extreme" position.

Then again the mainstream "right" has dropped the ball at every turn, like how they simply focused on whether Trump called nazis "very fine people" rather than exposing how James Fields hit the gas because he was threatened by a mob and that Heather Heyer was never struck by his car. Among the countless other lies about Cville and how the VA and Cville govs conspired to make shit hit the fan that day. And let's not forget how the mainstream "right" only came around to defending Kyle Rittenhouse once it became safe, whereas before only the "fringe" right had his back.

No matter how much you hate the mainstream "right," you don't hate them enough. They're only too eager to plunge a knife into the backs of the people actually putting themselves in the crosshairs of the regime while they enjoy air-conditioned offices and cocktail parties with their liberal friends.

Standing is a bullshit legal fiction in itself

It's 'they don't want to get whacked when their replacement will be a diversity hire' bullshit.

You might get more action on it when Trump gets in as:

  1. Both establishment left and right will want to limit the executive to limit Trump regardless of consequences

  2. Their replacements will at least be able to tell what the constitution details.

Lol thinking Trump will be able to do anything, if, and that's a big IF he somehow beats all the corruption and gets elected.

Remember the TDS the first time around? They divert and stonewall at every move he tries to make. Nothing will be accomplished. Which will actually be an improvement vs letting Obama run his shadow gov another term.

But no one will go to jail that deserves it. Trump is in bed with Israel as much as the rest of them.
