The studio further asks that the court award damages in the amount of $2,500 for each time Leone used cheat software in the game.

If a crime occurred, and you didn't even involve the authorities, that goes a long way to proving you weren't taking them seriously, which disproves damages entirely.
Criminal charges also don't preclude civil lawsuits.
