It is odd to me that she's not suing. She clearly went straight to the media with this story so I'm not sure what her angle is.
Waitresses tend to not have money lying around to afford a lawyer. This way she stands a good chance of either not needing one, or having them come out of the woodwork offering their services for free.
I'm fairly certain this violates many medical protections and privacy laws. She should be able to sue them successfully over the issue. I don't blame anyone hesitating taking a completely untested medication.

Given that the CDC itself says that they don't know how the vaccine impacts spread, there are absolutely no grounds to say that the vaccine does anything to mitigate a threat. I could be wrong but I believe this has been mostly left up to each state to administer through their own guidelines.
Food service jobs are considered essential and eligible for the vaccine.
