It only applies if the new hire is outside the US at the time the H1B petition is made. So for example jeets can simply come as """"""""""students"""""""""" or """"""""""tourists"""""""""" before getting their H1-B.

H1Bs should only exist in the following scenario:

Step 1: offer job to Americans

Step 2: if no qualified americans can be found increase salary for position for Americans

Step 3: if no qualified Americans can be found again, increase salary again for Americans

Step 4: if no qualified Americans can be found again, increase salary again for Americans

….

Step 999: if no qualified Americans can be found again, increase salary again for Americans

Step 1000: if you have not found an American willing to do what is necessary to become qualified for this job, society has probably collapsed, the world might have long died after nuclear holocaust caused by the international cliques / enclave groups, people probably don’t exist, it if they do, yeah sure, put out a Craigslist and see if anyone from India wants to come on over

There are sites like guestworkervisas.com or jobs.now where you can see the jobs and apply to them. The logic goes that if an American applies, they would have to give you an interview or consider the fact that they could hire an American, so the H1b is no longer valid for submission.

The laws surrounding H1b are outdated and use phrases like “job must be advertised in the paper and accept applications by mail”, so they will say “send resume to this PO Box” and use it to prevent Americans from applying and showing they’re willing to do that role.

However, I suspect the hiring managers just throw the application in the trash and pretend it never happened so they can hire their foreigners anyway.
