This is Federal charges though, they're like that to actually avoid "local judges" who were friends of the KKK.
Lemon was being charged for other things & a judge blocked those claiming "he's a journalist" BUT the Feds can surely connect him with the planning (he as much as admitted this on air) and then he's netted! As well as everyone else involved, even if they weren't there that day.
