Second because the judiciary can only make itself illegitimate so many times before there's blowback.
Remember that SCOTUS banned capital punishment in the US. There's a reason Florida just executed someone via firing squad.
I didn't remember the SC banned Capital Punishment. I had to look it up. They banned it 1972 and lifted it in 1976.
