To be honest, my only hesitation on the Death Penalty beyond the obvious have it only attached to the most serious crime (like I don't want to jaywalk and get the chair) is assurance of guilt.
However, A LOT of criminals even rapists and child molesters FILM their crimes so fuck it we got undeniable evidence, get the rope, chair or firing squad ready.
That's the problem though. The definition of "undeniable evidence" has radically changed over the years.
Things like fingerprints, "hair & fiber samples" and even eyewitness testimony has proven to be flawed at best and outright garbage at worst. Even DNA has its problems.
Never mind "confessions" and one of the worst: jailhouse informants.
It is possible to prove things with evidence, but so many cases in the past hung one ONE (1) piece of evidence and a LOT of conjecture. Executions for sloppy investigations from crooked police, lawyer & judges is an ugly reality.
Take for example the man convicted of rape/murder because the killer bit the victim, leaving a perfect set of toothmarks & had a "snaggletooth" which is very distinctive. He had one too, and although there was literally no other evidence they convicted him. Many years (8?) later he got a new lawyer for his appeal who noticed that the dental X-rays presented in court were backwards. The killer had a snaggle on the right, but the man did not, his was on the left. The ONLY piece of evidence to convict him actually exonerated him. It still (iirc) took a year to get him out of jail and they never did reverse the decision :/ just declined to re-try him.
