This workaround is explicitly called out in the decision as also unconstitutional, but they're trying to buy another 50 years of racist policies before the courts act on it.
Yeah he's quoting the dissent & the majority explicitly stated that "no, you can't just discriminate with a loophole, the dissent is wrong & isn't authority".
The libs won't comply. They will need to be sued dozens of times in favorable jurisdictions & hit with heavy judgments until they get so blasted with lawsuits that they finally cave in & switch to a merit-based racially blind system out of fear of lawsuits.
It will take at least 5-10 years to get to the point where we see a real end to racism in college admissions.
Was with you right up until, “and switch to a merit-based racially blind system“. The radical left never relents. They always double down. Just as you said, they won’t comply. You can already see them out on Reddit today, saying how the policy just needs to be switched to “socioeconomic”.
They’re going to do exactly what they do in California to get around it here. Discriminate exactly how they want, but just do it more nebulously.
Nothing but ending the left’s control of the narrative will stop them. If you change that, then you can have the public get upset at the situation, and if you can finally do that, you can finally work on driving them out of the positions they have entrenched themselves in, that allow them to enforce policies like this.
As always, the real issue is control of the narrative.

20-30. Recruiting, Marketing, and HR are littered with this shit, and everyone else in the college is a rabid Leftist who would rather die than not racially discriminate against their own staff and students.
There's a point of no return with institutional capture and Leftists. I compare it to making Eric Harris and Dylan Klebold hall monitors. You don't fire them. They'd rather burn down the school with everyone inside then remove them from power. Your only real option is to evacuate the ones who can leave, let the school be destroyed, and starve them out by cutting funding and income.
Reddit. Reddit is a perfect example of this.
Look what the shitbag left is doing over there, with regards to the stupid fiasco over the API changes.
First the power jannies locked nearly all the major subs (and tons of niche ones, as well) down for a couple of days, specifically so no one could use the site. Then, when their tantrum didn't get them what they wanted, they switched to longer/"permanent" blackouts. Then, when that didn't work, and they were told they were going to be removed as moderators if they didn't stop acting like toddlers, they doubled down on that, and started filling the entire site with porn, and stupid crap like the john oliver pics, etc, in an attempt to tank the value of the site by destroying its ability to host ads.
It's a perfect microcosm. It is exactly what happens when you let the radical left take control of something - i.e., you get what you fucking deserve.
The Left also knows that the only correct option is to purge them.
And even then they will still do it all begrudingly.
By that time I hope enough people will see the value in avoiding college.
Ya that won't happen because the courts are packed with the chosen few who have deep connections to Harvard, Yale, Princeton etc. They won't rule against their benefactors and support networks.
