The patent system was meant to deal with physical processes. Using it for software algorithms was a huge mistake. Even if software can be patented the length of exclusivity needs to be at the absolute most something like 5 years given how fast technology moves.

Copyright is a complete cluster, mostly caused by disney. AFAIK trademarks are handled in a somewhat sane manner.

IMO the correct solution is to require all IP holders to pay an annual "property" tax for enforcement. Something like .3% of the value seems ballpark reasonable. So if the Google trademark is worth 50 billion dollars Google would have to pay 150 million annually to retain it.

How we determine the value is the IP is auctioned off every year with a starting bid of whatever the owner sets. The bids would all be legally binding to prevent shenanigans. If someone bids greater than the minimum then the old owner gets the money, the IP is transferred, and the new owner pays tax on the new value. If nobody bids then the owner pays the tax on the minimum bid.

So you can copyright your blog post by registering and setting the value at $5 and paying 1.5 cents tax every year until you no longer feel like it, then the post becomes public domain.
