Even here in California, Affirmative Action was voted on, made illegal, then voted on again (to repeal the previous law banning it), and was still kept illegal. That doesn't stop the left from doing it, though.
Search on Google for how they substitute other factors to just do what they wanted to do (affirmative action) in the first place. (TLDR: university officials officially substitute other factors like income and parental education levels as proxies for race and ethnicity, and unofficially, they still go ahead and just take race/gender into consideration.)
Laws/rules don't mean anything to the left. What people really need to start understanding is that these people have been thoroughly indoctrinated to view themselves as being The Anointed (to use the term from Thomas Sowell's book), and that they are righteous crusaders here to save you (the Benighted) from your own ignorance, evil, whatever.
They do whatever the fuck they want, and then they rely upon their control of the media (traditional, and internet) to cover for them, to make sure any public anger is kept in check.

That's what's so insidious about the left. They can justify anything they do because in their minds it's for the greater good and they're supporting the march of progress to a better world.
So, when they break the law, or apply double standards between themselves and their opponents, it's all OK and morally correct in their minds.
On top of that, when they do x - and it doesn't show any of the results they promised - they just write it off as, "Well, If we didn't do x, it would have been a lot worse", or, "It just didn't work because we didn't do x hard enough".
That, combined with the point you brought up, is what makes the goddamned media (traditional and now tech) so freaking dangerous. The public being informed about what is actually going on (and getting mad about it) is the only moderator on stopping the stupid stuff the left engages in, and we now exist in a system where the media doesn't even pretend to be unbiased/professional in the slightest. Instead, they are running propaganda for the left, so - instead of being a moderator - they are being an accelerant.
The left's stranglehold on the narrative needs to be broken before anything else can happen.

Can't do it in California, but this is why DeSantis is purifying state college boards. You can make laws all day, but the rubber meeting the road there is the governing of these colleges, which has traditionally been done by unabashed Bolsheviks.
But since the stat is paying for the schools and lending their name, they should really be able to dictate what goes on in there. You'd like it to be apolitical, I guess, but it never has been.
