These jokes were from 2010-2013, the "human rights" tribunal made their decision in 2016 (not sure when that process started, could have easily been in 2013), and now finally in 2021 after hiring lawyers to take everything to the top court it's finally over. That's at least 5 yrs of battling for some jokes about a retard singing off-key.

In a 5-4 split decision, the Supreme Court ruled that while comic Mike Ward’s jokes ridiculed singer Jeremy Gabriel, who suffers from Treacher Collins Syndrome, Gabriel was targeted by Ward because of his fame, not his disability.
So, it's not quite declaring jokes legal. The court ruled that in this specific case, the joke was legal because it was about him being famous, not about him being disabled.
Joking about someone's disability is still illegal.
