There were so many idiots who tried to apply the first amendment to private companies, followed by smarter people pointing out that the first amendment only applies to the government and being overheard by dumber people who then go on to use that response to respond to people who say that companies should morally abide by the concept of free speech.
The same shit is happening with HIPAA. There are so many dumbasses who claim that HIPAA prevents an employer from asking you for your medical records and being rightfully corrected by smarter people saying that HIPAA does no such thing, that dumber people overhear this conversation and think anyone who believes a company is wrong or shouldn't be allowed to ask for medical records is just an idiot that doesn't understand the law.
At this point, the frees speech part of the first Amedmant should apply to businesses with a monopoly on political discourse.
Also, and I'm not saying you're conflating the two, but let's make sure we're separating the first amendment from the concept of freedom of speech. The two are heavily related, but they aren't the same thing.
The first amendment guarantees, among other things, that the government will not infringe on a person's right to freedom of speech.
There isn't a document or law guaranteeing that private companies will not infringe on a person's right to freedom of speech, but that doesn't mean it's a-ok for them to do so.

Really? that's funny. My fiance was asked by the company he worked for at the time (local pottery factory) for medical records for something, and when he went to our doctor, the guy about came unglued, called them up and read them the riot act.
Apparently he'd had to file complaints more than once over it.
But I guess when half your workforce are convicted felons and/or parolees, you figure they're not gonna risk their jobs to complain about you.
The problem I have with both those laws is they were drafted, pre Mob-justice era (IE 2007 upward).
They weren't ever drafted with it in mind if people started using a person's medical records or social presence as a weapon.
I'm fine with the records being accessed and looked at, but they shouldn't be used as a basis for impugning a punishment based on... Social hatred. It's the one thing I believe America gets very wrong, much like the whole at will firing in some states. No warning just bam.
I am pretty sure that is not the global concept of free speech as free speech is absolute, I think they are using the infamous "free speech but" definition designed to allow them to censor anything that violates their extremist ideologies.

There is a sour candy in Hungary called Negro that has nothing to do with black people. It's been around for a century or so, and got its name from the guy that came up with it (yes, his surname was Negro).
