That, and I interpret "he raped them" as "he performed sexual acts on them" which may very well not be true. For all we know the pictures were just kids posing. Again, an absolutely reprehensible act, but a different one, from my interpretation.

Children are incapable of giving consent. Any sexual acts with children are considered statuatory rape.
I assume he's saying that a photo can be pornographic even if no sex act is depicted.
