They should have never amended the Mann Act to exclude prosecution of adultery across state lines. Juries and judges were perfectly willing to convict for it for over 60 years.
If you want to have massive tax benefits for supposedly upholding family values and raising your children right, don't commit adultery and increase the chances of your children going through a divorce.
If you want a libertine lifestyle and an open marriage just get ceremonially married and leave taxpayers out of it.
Back in the gay marriage debates in the 00s I argued for exactly that. Get US government out of marriage altogether because it's obviously a religious institution and let people form up relationships as they want at will. Because if you redefine marriage as whatever you want than beastiality and polygamy are next.
