This wasn't an accident. If he turned himself in and remained at the scene of the crime and did everything he could to avert disaster, sure, he would deserve some leniency for that.
In the end it didn't matter that he called 911. Perhaps the death penalty might be a bit extreme in his case but this is a crime you'll have to atone for the rest of your life.
