Not only that, but with the recent SC ruling, they would also need to pierce POTUS immunity, a stupidly high bar that they can’t even hope to overcome without a wildly biased judge in their corner (which Judge Cannon is not).
They could try again in a different jurisdiction, but even replacing Smith would take weeks at least, because they would need to come up with a different procedure to nominate a new Special Prosecutor that they could try to argue is constitutional.
The whole thing could take months, and they would he even more insane ro reindict in October. The documents case is done.
Agreed. And they could, but there are also issues with things they did (grand jury in DC but charging him in FL, a dig no-no) that would need to be corrected. Plus if Smith is illegitimate I believe all evidence collected is fruit of the poisonous tree and can’t be used but I’m unsure. I’m not a lawyer I just play one on TV.
And it wouldn't help the Deep State at all to refile in October. That'll just prove there IS one and motivate independents to vote Trump.
