I would question the situation. Context always matters, despite what the Scottish courts say.
What is the context for the child's injury? What is the context for the negative statement about Judaism?
There are effectively zero baseline situations (that is, ones where context is not yet established) where no context is needed to make a decision.
Well, a child being raped in the street would warrant breaking the silence. But there is a universe of difference between child rape and some guy acting like a fool.
