There was an episode of that hateful, vile shit that is L&O:SVU where a victim's DNA was entered in the criminal database and they matched it to another crime. It's been a few years since I saw it because the show was watchable at the time and hasn't been in nearly 15 years. IIRC, they tossed it because it violated procedure and had to make a charge around if they had been able to connect the victim and perp in the old case.
Is it legal? Seems odd, they can't force you to give a DNA sample so I do not see how this is legal.
When they do the rape kits they test against your DNA to obtain the DNA of the rapist? Even then it should not go in to any database without your consent.
I think the women here has a real case for both damages and having her other case thrown out.
I am sure there are states where it is a gray area because no real law has been made to address it, or there are gray areas in the law where they can maneuver around it. Politicians really are scum that need to be flushed every cycle.
