They should be equal and if there is any disagreement between them it should immediately and automatically go to SCOTUS.

If Kavanaugh who oversees this Circuit Court wants to take the case then yes it will go to SCOTUS.
We will be lucky to get a 5-4 ruling at SCOTUS.
Only Alito, Thomas Gorsuch are guaranteed to rule in favor of stopping the OSHA mandate.
Kavanaugh and Barrett are squishes who side with the left on some cases.
Chief Justice Roberts is the ultimate squish, he often sides with the left.
I hope they rule against the mandates but it is hard to say with these three squishes.
So someone explain this to me. The stay was just the halt on the deployment of the mandate while both sides can make their case to the 5th circuit?
Cause I thought the stay was put in place so hearings could take place and the courts decide after the fact?
