It appears a movie produced in America using only American actors would be eligible for the foreign language award if 50% of the dialogue was in a language other than English. That is, it doesn't matter where the film is made or what it's about, only the dialog. If you were a munchkin you could make an almost silent film with one foreign words spoken and it would qualify.
So both Passion of the Christ and Apocalypto technically qualify as foreign films? For some reason it amuses me that Mel Gibson is a world-renowned foreign film director.

That being said, Bryan Adams was put in a "foreign" album category at a Canadian music awards because it was produced in the US, I think, and/or had too many Americans working on it.
I think it's because, as pretentious as the film scene can be, the foreign film scene tends to take it to the next level; and you have someone that the mainstream has declared to be some sort of anti-semitic white supremacist who none of these people would want to be caught in the same room with; and he's directed/produced two such films to wide release.
I imagine some GigaChad at a foreign film festival telling people "of course I like foreign films: Mel Gibson is my favorite director"
