If they can provide evidence of other people having pro-Biden flags or signs on their balcony then they have an actual legal case to bring against the management company. This is all dependent on the rules laid out in the lease. We lack that information to really make an opinion here.

They can probably ban flags in general, or things attached to balcony railings in general.
